TERMS OF SALE

These Terms of Sale (“Terms of Sale”) apply to all consumer subscriptions and purchases from Funimation Global Group, LLC (“Funimation”) in the United States and Canada. These Terms of Sale shall constitute Additional Terms under the Terms of Use. Except where prohibited by the laws of your jurisdiction (which may include Quebec), Funimation reserves the right to make any changes to the subscription service without notice.

  1. ACCOUNT, SUBSCRIPTION & BILLING.

    1. Account. You will need to register an account with us on the website or via one of our apps in order to take out a subscription with us and will have the option to do so when purchasing products from us. You must be 18 years of age or above to purchase a subscription and purchase products from us.

    2. Free Trials. At Funimation's sole discretion, Funimation may offer a free trial period to first-time customers, limit 1 per household and/or payment method provided. Terms of free trial offers, including duration of free trial, may vary. Your trial period begins the day you sign up for a Funimation subscription. FREE TRIALS ARE NOT AVAILABLE IN CANADA. Upon completion of the free trial period, your subscription to Funimation will automatically renew. YOU MUST CANCEL YOUR SUBSCRIPTION PRIOR TO THE END OF THE FREE TRIAL OFFER TO AVOID CHARGES TO YOUR PAYMENT METHOD.

    3. Special Offers. At Funimation's sole discretion, Funimation may offer promotional offers. Funimation does not guarantee that an offer will be made to any user of the Service. The terms and conditions of a special offer will only apply if the user responds affirmatively to the Special Offer. Terms of special offers, including the promotional price and duration of the promotional price, may vary from time to time.

    4. Billing. By starting a Funimation subscription, you are expressly agreeing that Funimation is authorized to charge your payment method for subscription services made on the website. Funimation accepts payment by credit card or PayPal or, for the online shop only, Funimation gift cards. You are responsible for any taxes or fees associated with website purchases. All fees and charges are nonrefundable. If you are the victim of identity theft and your website account is involved, you should immediately notify customer service. You should also report the instance to your credit card issuer and local law enforcement agency. Funimation reserves the right to place any account on hold at any time with or without notification to the user in order to protect itself or its partners from what it believes to be fraudulent activity. Funimation is not obligated to give you a credit or discount for holds placed on your account. Funimation may provide refunds or credits to subscribers at the sole discretion of Funimation. You are expressly authorizing Funimation to charge your payment method to renew your subscription if your subscription term ends and you have not cancelled your subscription. If your payment method for any reason does not accept the subscription charges, you are responsible for any uncollected amounts. Funimation may change subscription fees at any time, but will provide notice of any price changes to subscribers. The number of devices available for use per account and the number of simultaneous streams allowed may change from time to time at our discretion.

    5. Ongoing Membership. Your subscription will automatically renew until you cancel your subscription or Funimation terminates it. You must cancel the subscription before the end of its term to avoid being charged for another term.

    6. Cancellation & Termination. You may cancel your subscription to Funimation at any time, and cancellations will be effective at the end of your current subscription period. To cancel your subscription, go to your Account and click on Manage Subscription on the sidebar, then click on Cancel Subscription. If you have signed up for a subscription with Paypal, all payment method changes are managed in your Paypal account. See here for more information on how to cancel your account. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR UNUSED TIME IN SUBSCRIPTION TERMS. Funimation reserves the right to terminate your account for any or no reason. Once an account is terminated, the user will not be able to access it. Any content submitted by a user may or may not also be deleted. Funimation is not obligated to forward any of a user’s submitted content, account information, or other data related to a user’s account to such user or a third party. Upon account termination, Funimation will not be obligated to provide content, website services, or granted rights to the user. Termination of an account does not affect the user's obligations to Funimation under these Terms of Sale or the Terms of Use including, but not limited to, proprietary rights and ownership, indemnification, and limitation of liability.

  2. FEATURES & FUNCTIONALITY OF STREAMING SERVICE. From time to time, Funimation may make changes to features and services. Changes may happen without notice and may not be described in these Terms of Sale or the Terms of Use. Only registered users may access certain website features. Certain features will only be available to premium members.

    1. Streaming Videos. Funimation allows you to instantly stream video to watch on your computer and devices through applications. Funimation makes no representations about the quality of display or streaming speed. The service will only work on specified hardware and software platforms. It is the user’s responsibility to make sure that you have the proper software, hardware and internet connection to view the Funimation streaming videos. Funimation may at any time change the minimum hardware requirements and stop supporting certain software, with or without notice. Funimation makes no guarantees, representations or warranties concerning devices or compatibility of device with Funimation’s streaming service.

    2. Fees and Internet Connection. You are solely responsible for determining and paying any fees, charges or taxes in connection with your use of the Service including, without limitation, those imposed by any Internet service provider, carrier or governmental entity. You must have a high speed Internet connection in order to access and use certain aspects of the Service.

    3. Unavailability. The Service may not be available: (i) during any maintenance or update periods, any power or server outages; (ii) as a result of war, riots, strikes, social unrest; or (iii) as a result of other matters beyond the control of us or third parties.

  3. PRODUCT SPECIFICATIONS & PRICING. We strive to accurately describe our products or services offered on the Service; however, we do not warrant that such specifications, pricing, or other content on the Service is complete, accurate, reliable, current, or error-free. In the event of any errors relating to the pricing, availability, or specifications, Funimation shall have the right to refuse or cancel any orders in its sole discretion. If we charged your credit or other account prior to cancellation, we will reissue credit to your account. If a product you purchased from Funimation is not as described, your sole remedy is to return it, to cancel the purchase and receive a credit for the purchase price.

  4. SHIPPING INFORMATION. Funimation currently ships to the United States and Canada. We are not always able to ship to a PO box or an APO, but we can try to accommodate your request. If you place an order after 11:45 AM CST, your order will likely not ship until the following business day.

    Please note: Some exclusions do apply to the shipping fees noted above. These exclusions include several Funimation.com merchandise items. Shipping fees may be greater than what is noted above.

  5. TRACKING. When your order is ready to be shipped, you will receive a shipment confirmation email. The email will contain shipment details, your tracking number, and a link to the selected carrier site. To track the order, click on the tracking number located in your email. To track your order on funimation.com, visit "My Account" under "Wishlist/My Orders." Visit "My Order" and click the "Track My Order" link. You will need to sign in to access your account information. If your order was purchased using guest checkout, please visit https://www.funimation.com/guest_signin/ and enter your order information to track your order.

  6. AGE REQUIREMENT. Registered users and guests must be 18 years of age or older to purchase TV-MA and/or R rated content.

  7. TAXES. Individuals with billing addresses in the state of Texas, New York, or in Canada will be charged taxes on the purchase of physical items. The purchase of digital subscriptions and gift cards will not be charged tax.

  8. GIFT CARDS. To redeem a Funimation gift card, go to “My Account” at the top of the navigation bar. Go to the “Profile” section, then scroll down until you see the “Gift Card Balance” drop-down menu. Open the menu and you’ll see where you can redeem your gift card and check your current account balance.

  9. RETURNS POLICY.

    1. Damaged, Defective or Mis-shipped Products:
      We will be happy to replace the damaged/defective or mis-shipped item or issue a refund. Please email Funimation.Store@funimation.com with the Order Number along with a description of the issue. Please allow 48 hours from when you send your email for a response from our Customer Service Team. You will then receive an email with instructions on how to return the item. If you do not submit a return request within 45 days of receipt of shipment, you will not be eligible for a refund or a replacement item. Once we receive your item, we will issue a refund or send a replacement product. If requesting a refund, please allow up to 14 days for your refund to appear on your account.

    2. Returning Undamaged Products. Please send an email to Funimation.Store@funimation.com with the Order Number along with a description of the issue. Please allow 48 hours from when you send your email for a response from our Customer Service Team. You will then receive an email with instructions on how to return the item. In order for your return to be approved the item must meet all eligibility criteria below:

      • Must be factory-sealed, in new and undamaged condition
      • Include all original accessories and packaging
      • Must be returned to Funimation within 30 days of receiving your return request approval e-mail (This date can be found on the Order Details page for your order)

      Your item is NOT eligible for return if it is:

      • Damaged
      • In used condition
      • A gift card
      • A Funimation Streaming Service subscription
      • Opened software
      • Opened media items (movies, music, and video games)
      • A digital item
      • A free item purchased as part of a promotion
    3. Shipping Undamaged Products. Shipping instructions will be emailed to you from our Customer Service Team. Since the reason for the return is not the result of a Funimation error, the shipping cost plus additional fees will be deducted from your refund. Once we receive your item, we will issue a refund. Please allow up to 14 days for your refund to appear on your account.

    4. Returning Products with Digital Copy Codes. A product may be returned if the Digital Copy Code has already been redeemed. The Digital Copy Code associated with the product will be deactivated, and Digital Copy access will be revoked.

    5. Funko Pops & Figurines. For Funko Pops & Figurines, the printed box the Pops are packed in is considered part of the shipping container for the product— with the Funko Pop inside. Therefore, we are unable to offer refunds or exchanges due to damages to the box on Funko Pops.

  10. ORDER CANCELLATION. If you have placed an order and would like to cancel it, please contact us at Funimation.Store@funimation.com. Keep in mind, if you place an order after 11:45 AM CST, your order will likely ship the following business day. If you wish to cancel, contact us immediately so we may cancel the order before it ships. There is no guarantee we’ll be able to cancel the order.
