Funimation FAQs

If you have a question about Funimation, more than likely, our FAQ will have the answer. But if you don’t see what you’re looking for, please reach out to a member of our Support Team.

May I create new content using Funimation Properties?

Taking an artwork into a new medium such as 3D animation and/or creating fan fiction based on an existing artwork usually does not fall under Fair Use. For more on fair use, please see this Wikipedia entry: http://en.wikipedia.org/wiki/Fair_use

Such works are generally considered "derivative works", and the right to create such works is one of the exclusive rights of a copyright holder. 17 USC § 106(2)

If someone creates a derivative work without authorization from the copyright holder, they can be liable for copyright infringement. Whether we will seek to go after them or not, is another story... If the purpose is educational or demonstrative and it's limited to a rather short piece, it may indeed be Fair Use. But if someone starts making a new series or starts making 3D versions of several existing episodes, it's probably infringement - especially if they're taking "donations."

May I upload a video, such as an anime music video, using Funimation anime?

We cannot expressly authorize you to upload video or use Funimation's content. We can tell you, however, that we do not plan to take legal action against creators/distributors of anime-based media that qualifies as a fair use of the underlying animation. Nor do we tend to remove such media intentionally, provided that the video is clearly marked in a way that would identify it as a fair use [in the title] such as a satire, parody, review or critique. For more on fair use, please see this Wikipedia entry: http://en.wikipedia.org/wiki/Fair_use

Also, please bear in mind that video streaming services such as YouTube occasionally employ "video fingerprinting" technology to identify and remove videos containing ANY unauthorized footage, whether it's arguably a fair use or not.

Basically, while we cannot expressly authorize you to upload such media, we will not actively seek to remove any that you do decide to upload, provided that it is [and is readily identifiable as] a fair use of the media, such as a satire, parody, AMV, critique or review. If you believe your content was taken down in error, please file a counter-notification for alleged infringement at http://video.google.com/support/bin/request.py?contact_type=cyc and follow the instructions, or submit a ticket with a member of our Support Team at Funimation.com/support.
