I don't think anybody is arguing the legal standing of what went on. It is undeniable fact that DCTP was operating illegally.
What is also undeniable fact is that Funi is over 500 episodes and 10 movies behind where DC is in Japan with no plans to continue the series (at least as far as has been announced at this time, to my knowledge). They are effectively sitting on the license doing nothing with it. It is also undeniable fact that you cannot lose money on a product you were not selling--so Funimation wasn't losing money on the majority of those episodes and movies. (Arguable for those episodes and movies which did see a dub release.)
I suppose the Japanese company could have been losing money from Japanese fans who decided to watch the fansubbed stuff for free instead of buying the DVDs. But, really, it's the English-speaking fanbase that's getting screwed over here. I highly doubt that a bunch of us are going to suddenly go out and import a bunch of movies/episodes in a language we can't understand to support the Japanese company since it's not like importing the series would actually help get the rest of it released or anything.
